These terms govern your use of Ostgate, a macOS application for connecting to Google Compute Engine instances through Identity-Aware Proxy, and of this website. By downloading or using the application you accept them.

Licence

You are granted a personal, non-exclusive, non-transferable, revocable licence to install and use Ostgate on Macs you own or control, for your own purposes or those of the organisation you work for. During the beta period this licence is free of charge.

You may not sell, sublicense or redistribute the application as your own, remove or obscure its notices, or represent it as a Google product.

Your Google Cloud account is yours

Ostgate acts entirely as you. It can reach only what your own Google account and IAM permissions already allow, and every action it takes against Google Cloud is an action attributable to you, subject to your organisation's policies and to your agreement with Google. You remain responsible for what you do with it, including any charges Google bills you for the resources involved.

You are also responsible for complying with your employer's and your organisation's rules about which tools may be connected to their cloud environment.

No warranty

Ostgate is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the application will be uninterrupted, timely, secure or error-free, nor that it is suitable for any particular production or regulated use.

This is beta software for connecting to infrastructure. Assess it against your own requirements before you depend on it.

Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or exemplary damages, nor for loss of profits, data, use or goodwill, arising out of or in connection with your use of or inability to use Ostgate, whether based in contract, tort or any other legal theory, and whether or not we were advised of the possibility of such damages.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, and if you are a consumer, your statutory rights are unaffected.

Third-party services and software

Ostgate connects to Google Cloud services that are governed by your own agreements with Google, not by these terms. It also incorporates open-source components, each of which remains subject to its own licence. Those licences and their notices are reproduced in full in the application (application menu → Acknowledgements) and in the Acknowledgements.txt file shipped in the disk image.

Changes and availability

We may update the application and these terms. Revised terms take effect when published at this address with a new date. We may also stop distributing the application or any of its features; installations you already have will continue to work as they are, subject to what Google's APIs continue to support.

Trademarks and affiliation

Ostgate is not affiliated with, endorsed by, or sponsored by Google or by Apple. Google Cloud, Compute Engine and Identity-Aware Proxy are trademarks of Google LLC. macOS, Apple Silicon and Secure Enclave are trademarks of Apple Inc. These marks are used only to describe interoperability.

Governing law

These terms are governed by the laws of the jurisdiction in which the publisher is established, without regard to conflict-of-law provisions.
